What is the meaning of easement?

The easement is the right given to a person to use someone else property, according to Realtor. This means that the person who uses the property does not own the property. The easement can also be used in other areas where a person can give another person limited legal rights to use their equipment.

Example of easement

Let’s say that you have a rental home and there is a tenant who is currently living in it. Your tenant is a professional Gardner but has no land to practice his/her profession. So, your tenant approaches you to ask if he/she can use the backyard to create a market garden.

If you agree that the tenant uses your land, you will draft terms that the tenant must follow while gardening. For example, you can tell them that the land can only be used to garden vegetables for 5 years without using artificial fertilizer or other chemicals. These temporary rights will allow your tenant to use the land for the gardening purpose only.

If the tenant brings animals on the backyard and they are not included in the terms, they will be violating the terms of use.

Another good example is when a person lets their neighbor put a water line on their property. The neighbor will not have legal rights to the property even if their water line runs through it. Furthermore, the neighbor can only use the land for the waterline.

If the neighbor wants to use the property for something else, they must have permission from the owner of the land.
